Effective Date: [MONTH DAY, YEAR]
These Terms & Conditions ("Terms") form a legally binding agreement between you and Beyond Generations LLC, doing business as Beyond ("Beyond," "we," "us," or "our").
These Terms govern your access to and use of the Beyond website, applications, and services. The "Services" include BeyondSchool, family and student profiles, work samples, portfolios, attendance tools, reports, memories, journals, Future Letters, Time Capsule features, Autofill, Generated Summary, and any other Beyond feature or service that links to these Terms.
By creating an account, purchasing a subscription, accessing, or using the Services, you agree to these Terms and acknowledge our Privacy Policy.
1. Eligibility
You must be at least 18 years old and legally capable of entering a binding agreement to own a Beyond account.
By creating an account, you represent that:
- you meet these eligibility requirements;
- the information you provide is accurate;
- you have authority to create profiles for the children and family members you add;
- you are the parent or legal guardian of any child for whom you provide consent, or you are otherwise legally authorized to act for that child; and
- you will use the Services in accordance with applicable law.
A person age 13 through 17 may create their own sign-in only through an invitation to an adult-controlled family account and with the permission and supervision of a parent or legal guardian. The Account Owner controls that person's family role and access. Family manager permissions are available only to adults.
A child under 13 may not create login credentials, accept these Terms, purchase a subscription, or provide consent on their own behalf. An adult Account Owner may create and manage a child profile for them.
2. Family Accounts and Permissions
The adult who creates the family account is the "Account Owner."
The Account Owner may be able to:
- create family-member and child profiles;
- invite other adults or family members;
- assign roles and permissions;
- control who can view or edit Family Content;
- purchase, change, or cancel a subscription;
- export information;
- remove authorized users; and
- delete profiles or the family account.
The Account Owner is responsible for activity under the account, including activity by invited users and child users, except to the extent the activity results directly from Beyond's failure to use reasonable security measures.
Inviting another person gives that person access according to the permissions selected. The Account Owner should provide access only to trusted people, review permissions periodically, and remove access when it is no longer appropriate.
3. Account Security
You agree to:
- provide accurate account information;
- keep account credentials confidential;
- use reasonable security measures;
- avoid sharing an adult login with a child;
- promptly remove access from unauthorized users; and
- notify Beyond promptly of suspected unauthorized access.
You may not access another person's account without authorization.
Beyond may require a password reset, additional verification, or a temporary account restriction when we reasonably believe an account may be compromised or used unlawfully.
4. The Services
Beyond provides tools that help families capture, organize, preserve, and share information within an authorized family account.
Features may include:
- family and student profiles;
- work samples;
- educational portfolios;
- attendance tracking;
- reports;
- journals;
- memories;
- Future Letters;
- photographs, video, audio, and document storage;
- Autofill and Generated Summary;
- family sharing; and
- export tools.
We may introduce, modify, test, suspend, or discontinue features. We will provide reasonable notice when a material change substantially reduces a paid Service, except when immediate action is reasonably necessary for security, legal compliance, prevention of abuse, or protection of a child or another person.
Some features may be described as beta, preview, experimental, or early access. These features may be incomplete, may change without notice, and may contain additional errors.
5. Beyond Is Not a School or Professional Adviser
Beyond is a family organization, education-recordkeeping, and memory-preservation platform.
Unless we expressly agree otherwise in a separate written agreement, Beyond is not:
- a school;
- an accredited educational institution;
- a teacher;
- a curriculum provider;
- a government recordkeeping agency;
- a transcript-certification service;
- a legal adviser;
- a tax adviser;
- a healthcare provider; or
- the official custodian of a family's homeschool records.
Laws governing homeschooling, attendance, educational records, assessments, graduation, transcripts, and retention vary by jurisdiction.
You are responsible for:
- determining the requirements that apply to your family;
- verifying the accuracy and completeness of your records;
- maintaining any legally required documentation;
- submitting information to the appropriate authority;
- keeping independent copies of important records; and
- obtaining professional advice when appropriate.
A report, portfolio, attendance record, summary, or export produced by Beyond does not guarantee compliance with any law, school policy, college requirement, scholarship requirement, or government standard.
Optional height, weight, or growth records are provided for family recordkeeping and are not medical advice or a substitute for professional medical care.
6. Autofill, Generated Summary, and Automated Features
Beyond may provide tools that analyze user-selected content and suggest:
- titles;
- dates;
- subjects;
- descriptions;
- transcriptions;
- summaries;
- tags;
- educational categories; or
- other information.
These results may be inaccurate, incomplete, or inappropriate.
You are responsible for reviewing, correcting, and approving generated or extracted information before relying on it, including before using it in an educational record, report, portfolio, legal submission, or other important document.
Beyond does not guarantee that generated information is accurate, original, legally compliant, or suitable for a particular purpose.
Private Family Content will not be used to train general-purpose models. Beyond also requires service providers processing private Family Content not to use it to train models for their own purposes.
If Beyond ever offers an optional program that would use Family Content for a materially different purpose, Beyond will provide a separate explanation and request express permission. Declining that optional request will not prevent access to the core Services.
7. Family Content
"Family Content" means information, files, photographs, videos, audio, documents, work samples, journals, memories, Future Letters, records, messages, and other material submitted through your account.
7.1 You retain ownership
As between you and Beyond, you retain ownership of your Family Content.
These Terms do not transfer ownership of Family Content to Beyond.
7.2 Limited license to operate the Services
You grant Beyond a limited, worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, transmit, display, back up, and process Family Content only as reasonably necessary to:
- provide the Services;
- make content available to users you authorize;
- perform features you request;
- protect and secure the Services;
- troubleshoot technical problems;
- comply with law; and
- enforce these Terms.
This license allows Beyond to engage service providers that process Family Content on our behalf, subject to appropriate confidentiality, use, and security restrictions.
This license does not permit Beyond or its service providers to use private Family Content for targeted advertising or to train general-purpose models.
The license ends when the content is deleted from our systems, except for temporary backup copies, information retained for security or legal reasons, and deidentified information that cannot reasonably be associated with a person or family.
7.3 Your responsibilities for Family Content
You represent and agree that:
- you own the Family Content or have permission to provide it;
- you have authority to provide personal information about the children and family members included in it;
- your submission and authorized sharing of the content do not violate another person's rights;
- you will not upload unlawful, exploitative, or harmful content;
- you will select appropriate sharing permissions; and
- you will not use Beyond as the only copy of irreplaceable content or legally required records.
Do not upload confidential information belonging to a school, employer, healthcare provider, or another organization unless you have authority to do so.
Beyond is not designed to store Social Security numbers, government identification numbers, financial-account credentials, medical records, or similar high-risk records. Do not upload this information unless Beyond expressly introduces a feature designed to collect it.
8. Privacy and Parental Consent
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information and is incorporated into these Terms.
The Account Owner is responsible for providing any notices and obtaining any permissions required from family members before submitting information about them.
Where Beyond is legally required to obtain verifiable parental consent directly, Beyond will provide the relevant parental notice and consent process.
A verified parent or legal guardian may withdraw consent or request deletion of a child's information. Doing so may disable features that require that information.
9. Family Sharing
Beyond may allow the Account Owner to share information with invited family members, caregivers, tutors, or other authorized users.
You understand that:
- invited users may view or edit information according to their assigned role;
- information may remain visible until access is removed;
- an authorized user may make copies outside Beyond;
- Beyond cannot control copies independently created by an authorized recipient; and
- the Account Owner is responsible for choosing appropriate recipients.
Beyond does not make private Family Content publicly available by default.
Any future public, community, marketplace, or nonessential external-sharing feature may be governed by additional notices, permissions, or terms.
10. Subscriptions, Billing, and Renewal
10.1 Free and paid plans
Beyond may offer free plans, paid subscriptions, trials, or promotional periods.
The price, billing interval, included features, storage allowance, and renewal terms will be displayed before purchase.
10.2 Automatic renewal
Unless the checkout page states otherwise, paid subscriptions automatically renew for successive monthly or annual periods until canceled.
By purchasing an automatically renewing subscription, you authorize Beyond or its payment provider to charge the applicable subscription fee and taxes to your selected payment method at the beginning of each renewal period.
Before purchase, Beyond will clearly disclose:
- that the subscription continues until canceled;
- the recurring price;
- the billing interval;
- the length of the renewal term;
- the deadline or method for canceling before the next charge;
- whether the price may change; and
- any minimum commitment.
10.3 Subscription acknowledgment
After purchase, Beyond will provide an acknowledgment in a form you can retain. The acknowledgment will include or link to:
- the subscription selected;
- the price and billing interval;
- the automatic-renewal terms;
- the cancellation policy; and
- instructions for canceling.
10.4 Trials and promotional periods
The duration and conversion terms of a trial or promotional period will be disclosed before enrollment.
Unless canceled before the disclosed deadline, a trial or promotional subscription may convert to a paid subscription.
Where required, Beyond will send a reminder before the cancellation deadline for a trial or promotional period.
Eligibility for a trial may be limited to new users or one trial per household.
10.5 Cancellation
A subscription purchased directly from Beyond may be canceled through the online account settings or another timely and easy-to-use online cancellation method identified in the subscription acknowledgment.
Cancellation stops future renewals. Unless otherwise stated or required by law, you will retain access to paid features through the end of the current paid billing period.
Deleting the app or deleting an account does not automatically cancel a subscription unless the cancellation flow expressly states otherwise.
10.6 App-marketplace subscriptions
Subscriptions purchased through Apple, Google, or another app marketplace must generally be managed through that marketplace.
The marketplace's billing, cancellation, and refund rules may apply in addition to these Terms.
10.7 Refunds
Except where required by law or expressly stated in an offer, subscription charges are nonrefundable, and Beyond does not provide prorated refunds for unused portions of a billing period.
This section does not limit any refund or cancellation right that cannot legally be waived.
10.8 Price changes
Beyond may change subscription prices by providing advance notice.
A price change will normally take effect at the first renewal after the notice period. You may cancel before that renewal to avoid the new charge.
10.9 Failed payments
If a payment fails, Beyond may:
- retry the payment;
- request an updated payment method;
- limit paid features;
- downgrade the account; or
- suspend the subscription.
Where reasonably possible, Beyond will provide an opportunity to resolve the payment issue before deleting stored Family Content.
10.10 Taxes
Prices may exclude applicable taxes. You are responsible for taxes associated with your purchase, except taxes based on Beyond's income.
11. Storage Limits, Backups, and Export
Plans may include limits on:
- total storage;
- number or size of files;
- video or audio duration;
- processing volume;
- number of profiles;
- number of portfolios; or
- other feature usage.
Material limits will be described in the plan or within the Services.
Beyond uses safeguards and backup processes designed to preserve Family Content, but no online service can guarantee permanent or uninterrupted storage.
You should maintain independent copies of irreplaceable content, including:
- original family photographs and videos;
- important educational records;
- legal records;
- graduation or transcript information;
- journals;
- memories; and
- Future Letters.
Beyond may provide tools to export content. Export formats and completeness may vary by feature, file type, and subscription plan.
12. Future Letters and Scheduled Content
Beyond will use reasonable efforts to preserve and make a Future Letter or other scheduled content available on the date selected by the user.
Availability or delivery may be affected by:
- account deletion;
- expired subscriptions;
- outdated recipient contact information;
- inability to verify a recipient;
- changes in law or technology;
- service discontinuation;
- technical failures; or
- circumstances outside Beyond's reasonable control.
Future Letters and scheduled content must not be used as the sole repository for irreplaceable information, emergency communications, wills, trusts, estate-planning documents, medical directives, passwords, financial credentials, or legally binding instructions.
13. Acceptable Use
You may not use the Services to:
- violate a law or another person's rights;
- exploit, endanger, groom, threaten, or harass a child or another person;
- upload child sexual abuse material or other unlawful sexual content;
- impersonate another person or misrepresent your authority over a child;
- disclose another person's private information without appropriate authority;
- upload malware, malicious code, or destructive files;
- attempt to bypass authentication, authorization, or security controls;
- gain unauthorized access to an account, system, or network;
- probe or test vulnerabilities without written authorization;
- scrape, harvest, or systematically extract information;
- interfere with the availability or operation of the Services;
- use automated systems in a way that creates an unreasonable load;
- reverse engineer the Services except where applicable law expressly permits it;
- remove copyright, trademark, or proprietary notices;
- use the Services or Beyond's proprietary materials to build or train a competing product;
- resell or commercially exploit the Services without written permission; or
- use the Services in a way that could reasonably harm Beyond, our users, children, or service providers.
Beyond may investigate suspected violations, preserve relevant information, remove content, restrict access, or report unlawful activity when appropriate.
14. Beyond Intellectual Property
Beyond and its licensors own the Services, including:
- software;
- source code;
- designs;
- interfaces;
- branding;
- logos;
- templates;
- original prompts and questionnaires;
- documentation; and
- other proprietary materials.
Except for the limited right to use the Services under these Terms, no intellectual-property rights are transferred to you.
You may not use Beyond's name, logo, or branding in a way that suggests sponsorship, endorsement, or affiliation without written permission.
15. Feedback
You may provide ideas, suggestions, or feedback about Beyond.
You grant Beyond permission to use feedback without restriction or compensation, provided that Beyond does not publicly identify you as the source without permission.
This section does not give Beyond ownership of your Family Content.
16. Third-Party Services
The Services may interact with payment providers, app marketplaces, authentication providers, hosting providers, user-selected export destinations, or other third-party services.
Beyond is not responsible for an independently operated third-party service. Your use of that service may be governed by separate terms and privacy policies.
17. Service Availability
Beyond works to make the Services reliable, but does not guarantee that they will always be:
- uninterrupted;
- error-free;
- available in every location;
- compatible with every device;
- free of delay or data loss; or
- maintained indefinitely.
Beyond may conduct maintenance, respond to security incidents, or experience events outside its reasonable control.
Where reasonably possible, Beyond will provide notice of material planned interruptions.
18. Changes to the Services or Terms
Beyond may update these Terms to reflect:
- changes to the Services;
- legal or regulatory requirements;
- security needs;
- new features; or
- business changes.
Beyond will provide reasonable notice of material changes. Updated Terms become effective on the date stated in the notice.
Where required by law, Beyond will ask you to affirmatively accept updated Terms.
If you do not agree to materially revised Terms, you may stop using the Services and cancel your subscription before the changes take effect.
19. Suspension and Termination
19.1 Termination by you
You may stop using Beyond at any time.
You may cancel a paid subscription as described in Section 10. You may separately delete profiles or request deletion of the family account.
Subscription cancellation and account deletion are separate actions unless the Services clearly state otherwise.
19.2 Suspension or termination by Beyond
Beyond may suspend or terminate access when reasonably necessary because:
- you materially violate these Terms;
- payment remains overdue;
- the account presents a security risk;
- Beyond reasonably suspects fraud or unauthorized access;
- the account is being used unlawfully;
- continued service could harm a child or another person;
- a legal requirement applies; or
- Beyond discontinues the Services.
Where appropriate, Beyond will provide notice and an opportunity to correct the issue.
Beyond may act immediately when necessary to protect children, users, systems, personal information, or legal rights.
19.3 Access to content after termination
Where reasonably possible, Beyond will provide an opportunity to export Family Content before a nonurgent account termination or material discontinuation of the Services.
Beyond is not required to preserve content indefinitely after termination. Information will be retained and deleted according to the Privacy Policy.
20. Copyright and Intellectual-Property Complaints
Beyond respects intellectual-property rights.
If you believe material stored or made available through the Services infringes your copyright or another intellectual-property right, contact:
Email: [email protected]
Mail: Beyond Generations LLC, [PUBLIC MAILING ADDRESS], [CITY, STATE ZIP]
Your notice should identify:
- the protected work or right;
- the material you believe is infringing;
- where the material is located;
- your contact information;
- why you believe the use is unauthorized; and
- a statement that the information in your notice is accurate and that you are authorized to act.
Beyond may remove or restrict content and may terminate repeat infringers when appropriate.
21. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available."
Beyond disclaims implied warranties of:
- merchantability;
- fitness for a particular purpose;
- noninfringement;
- accuracy;
- availability; and
- quiet enjoyment.
Beyond does not warrant that:
- records will satisfy a legal or educational requirement;
- generated or extracted suggestions will be accurate;
- content will never be lost;
- a Future Letter will always be delivered or available;
- the Services will be uninterrupted; or
- every security threat can be prevented.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
22. Limitation of Liability
To the fullest extent permitted by law, Beyond and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of:
- data;
- memories;
- educational records;
- profits;
- goodwill;
- opportunities; or
- anticipated savings.
To the fullest extent permitted by law, Beyond's total liability arising from or relating to the Services will not exceed the greater of:
- the amount you paid directly to Beyond during the 12 months before the event giving rise to the claim; or
- $100.
These limitations do not apply where liability cannot legally be limited, including categories excluded by applicable law.
23. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Beyond harmless from third-party claims arising from:
- Family Content you submit;
- your unlawful use of the Services;
- your material violation of these Terms;
- your violation of another person's rights; or
- your misrepresentation that you had authority to provide information about a child or family member.
This obligation does not apply to the extent a claim results from Beyond's negligence, willful misconduct, or violation of law.
Beyond will provide reasonable notice of a covered claim and allow you to participate in the defense. You may not settle a claim in a way that admits wrongdoing by, or imposes an obligation on, Beyond without Beyond's written consent.
24. Governing Law and Disputes
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles.
Before filing a lawsuit, you and Beyond agree to make a good-faith effort to resolve the dispute informally. A written dispute notice should describe the issue and requested resolution and be sent to [email protected].
If the dispute is not resolved within 30 days after receipt of the notice, either party may pursue available legal remedies.
Except where applicable consumer law provides otherwise, disputes will be brought in the state or federal courts located in [COUNTY], Illinois, and each party consents to their jurisdiction.
Either party may bring an eligible individual claim in small-claims court.
Nothing in these Terms prevents either party from seeking emergency or injunctive relief to protect children, account security, personal information, confidential information, or intellectual-property rights.
Nothing in these Terms limits a consumer right or remedy that cannot legally be waived.
25. General Provisions
25.1 Entire agreement
These Terms, the Privacy Policy, applicable subscription disclosures, and any feature-specific terms form the entire agreement between you and Beyond concerning the Services.
25.2 Severability
If a provision is found unenforceable, it will be modified to the minimum extent necessary or removed, and the remaining provisions will remain effective.
25.3 No waiver
A failure to enforce a provision is not a waiver of the right to enforce it later.
25.4 Assignment
You may not transfer your account or these Terms without Beyond's permission.
Beyond may assign these Terms as part of a merger, acquisition, restructuring, financing, or sale of the business, subject to the privacy protections described in the Privacy Policy.
25.5 No third-party beneficiaries
Except as expressly stated, these Terms do not create rights for third parties.
25.6 Headings
Section headings are for convenience and do not affect interpretation.
25.7 Electronic communications
You consent to receive agreements, notices, disclosures, and other communications electronically. You may retain copies for your records.
